Terms of use

1. The deal

thisfeeling lets a group build a moment for someone's day: messages from everyone, played as one film on the day, with extras if you like. It's free to make. Keeping a moment forever and a few extras cost a one-time payment. These terms are between you and Vikba ApS, Ordrup Jagtvej 42A, st. th., 2920 Charlottenlund, Denmark, CVR 40234047.

2. Who can use it

  • You must be 16 or older to create an account.
  • Anyone with a link can add a message to a moment, or open a moment made for them, without an account.
  • One person, one account.

3. Be kind: the one big rule

Moments are for kind, heartfelt messages. You may not use thisfeeling to:

  • insult, harass, threaten, shame or pressure anyone, even as a joke;
  • add sexual content, or anything involving minors in an inappropriate way;
  • add spam, ads or anything illegal;
  • pretend to be someone else;
  • add photos or recordings of other people without their permission.

We can remove content, or close an account, when it's needed to keep people safe, and we'll tell you why when we can.

4. Your content

  • You own what you add: your messages, photos, words and answers.
  • You give us a limited licence to store, process and show it only to the people in the moment, and only to run the service (for example to put your message in the film). We don't use it for ads, we don't sell it, and we don't use it to train AI.
  • The organizer can change the order of messages, trim the start and end of a message, and hide or remove messages in their moment. Nobody can change what you said.
  • You're responsible for having the right to add what you add (for example photos taken by others, or music in the background).

5. Organizers

  • The organizer runs the moment: dates, look, extras, order, whether guests see who's in, and deleting the moment.
  • The organizer should only invite people who would want to take part, and share the link in private chats.
  • A co-organizer can do everything the organizer can, except delete the moment.

6. Free and Forever

  • Free: up to 10 messages in the film, of up to 1 minute each, online until 30 days after the day, 10 old photos in the timeline, one word and 1 quiz question. Messages over the limit are kept, never thrown away, and join the film with Forever.
  • Forever: a one-time payment per moment (€10 before the day, €19 after, VAT included) that keeps it online and adds everything listed in the app, including as many quiz questions as you like.
  • One person pays for the whole moment, and everyone in the moment gets Forever. Before the day this is usually the organizer; after the day anyone in the moment can pay.
  • Right of withdrawal: Forever is digital content delivered right away. When you pay, you ask for it to start immediately and accept that the 14-day right of withdrawal ends once it has been delivered.
  • No refunds, except where the law gives you a right to one.
  • Forever means for as long as thisfeeling exists. If we close, we'll give everyone at least 30 days to download their moments.
  • Prices can change for new purchases. A moment you've already kept forever stays kept.

7. Deleting things

  • You can delete your own messages at any time when you have an account, and delete your account in the app.
  • The organizer can delete the whole moment at any time.
  • Free moments are deleted for good 30 days after the day, after reminders.
  • If someone downloaded a message or the film, we can't delete their copy.

8. Something wrong?

Tell the organizer, who can hide or delete any message. You can also write to [email protected], including to report illegal content. We look at every report as quickly as we can, usually within 48 hours.

9. The service

We work hard to keep thisfeeling running, but it's provided as it is. We can change or stop features. Nothing in these terms limits your rights as a consumer under mandatory law.

10. Liability

We're not liable for indirect losses, or for content other people add, as far as the law allows.

11. Changes to these terms

We'll tell account holders before important changes take effect.

12. Law and disputes

Danish law applies. You can always use the courts and consumer rights of the EU country where you live.
